StratoVox Business Voice and Messaging Services Acceptable Usage Policy

Please read this acceptable use policy ("policy", “AUP”) carefully before using our services.

Definitions

StratoVox Inc, StratoVox Inc employees and/or executives are henceforth known as StratoVox.

The company, organization, persons representing or legally able to bind said company or organization, including an individual subscribing to StratoVox Voice or Messaging services are collectively henceforth known as the client.

StratoVox Services refer to StratoVox Inc.Voice and/or Messaging services


Overview

It is the responsibility of the client to read and review this Fair Usage Policy and assumed if the client subscribes and makes use of StratoVox Voice and/or messaging service the client agrees to the policies set out herein.

Voice and/or Messaging Services provided by StratoVox may only be used for lawful and professional purposes. The client agrees to comply with all applicable laws, rules, and regulations in connection with the client’s use of StratoVox Services. Any material or conduct that, in our judgment violates this policy in any manner, may result in suspension or termination of the services or removal of the user’s account with or without notice.


Prohibited use

The Client may not use StratoVox services to publish content or engage in activity that is illegal under applicable law, that is harmful to others, or that would subject us to liability, including, without limitation, in connection with any of the following, each of which is prohibited under this Fair Usage Policy:

  • Phishing or engaging in identity theft.
  • Distributing computer viruses, worms, trojan horses or other malicious code.
  • Distributing pornography or adult related content or offering any escort services.
  • Promoting or facilitating violence or terrorist activities.
  • Infringing the intellectual property or other proprietary rights of others.
  • Participating in unlawful business practices, scams or related actions.

Enforcement

Your services may be suspended or terminated with or without notice upon any violation of this policy. Any violations may result in the immediate suspension or termination of your account.


Fair Use of StratoVox Voice Services

Unlimited voice services are for live dialog between two live individuals, these are provided for personal or business use only. If the client use of StratoVox unlimited voice services (including conference calling or call forwarding) is deemed to have a negative impact on StratoVox or StratoVox partners’ networks and hinders other clients’ ability to enjoy our services, StratoVox may, at its discretion, terminate or suspend your service, or change your plan to one with no unlimited usage components. Unacceptable uses are, but not limited to:

  • Voice usage that grossly exceeds the average typical customer usage.
  • Automated Outbound Call Centre sales or canvasing (for more information on StratoVox call centre solutions, please contact us)
  • Voice calls that are deemed to have abnormal durations. For example: many short calls to different phone numbers or few calls of long duration.

Where reasonable, Stratovox will provide the client with notice of improper usage before suspension or termination of the client’s service and, if appropriate, Stratovox may offer the client an alternative plan.


Fair Usage Policy for Messaging Services

By subscribing to StratoVox’s messaging services you and the client agrees to abide by all applicable municipal, provincial, federal and international regulations and laws. The client is solely responsible for all acts and omissions that occur under the client’s account. These acts or omissions include without limitation the content of the messages and broadcasts that the client creates or initiates through the messaging service. The client also agrees to read and perform due diligence to understand the legalities regarding messages, broadcasts and campaigns transmitted through messaging services. The following is a list of some but not all resources available:

  • Canadian Radio-television and Telecommunications Commission
  • Canadian Wireless Telecommunications Association (CWTA)
  • Canada’s Anti-Spam Legislation (CASL)
  • Common Short Code Administration
  • Mobile Marketing Association
  • CTIA

StratoVox is not and will not interpret or provide interpretation of any laws or regulations. These links/resources are provided are a courtesy only. The client is responsible for ensuring it has an understanding of the content of all or specific information sources that apply to the client’s use case(s) and that the client is complying to the corresponding rules, laws and/or regulations.

The client acknowledges and agrees that StratoVox is under no circumstances, responsible for the contents and/or accuracy the messages the client sends, receives or broadcasts using the StratoVox services. StratoVox will not be liable for any misuse of StratoVox services by the client. The views and/or opinions contained in any of the client’s messages, broadcasts or communications are not those of StratoVox.

Where reasonable, StratoVox will provide the client with notice of improper usage before suspension or termination of the client’s service. If appropriate, StratoVox may offer the client an alternative plan. The client may NOT use StratoVox services to:

  • send unsolicited marketing messages or broadcasts (i.e. spam).
  • send any messages or calls to life-line services, such as hospitals, fire, police, 911 or utility- related telephone numbers.
  • harvest, or otherwise collecting information about others, without their consent.
  • mislead others as to the identity of the sender of the client’s messages or broadcasts, by creating a false identity, impersonating the identity of someone/something else or by providing contact details that do not belong to the client.
  • transmit, associate or publish any unlawful, racist, harassing, libelous, abusive, threatening, demeaning, immoral, harmful, vulgar, obscene, pornographic or otherwise objectionable material of any kind.
  • transmit any material that may infringe upon the intellectual property rights of third parties including trademarks, copyrights or other rights of publicity.
  • transmit any material that contains viruses, Trojan horses, worms, time bombs, cancel-bots or any other harmful/deleterious programs.
  • interfere with, or disrupting, networks connected to the StratoVox services or violating the regulations, policies or procedures of such networks.
  • attempt to gain unauthorized access to StratoVox services, other accounts, computer systems or networks connected to the StratoVox services, through password mining or any other means
  • engage in any other activity that StratoVox believes could subject it to criminal liability or civil penalty/judgment.
